These Terms of Service (“Terms”) govern your access to and use of the website, landing pages, booking pages, and services provided by AM Automations Unlimited LLC (“AM Automations,” “we,” “us,” or “our”), a Florida limited liability company based in Miami, Florida. By accessing our website or submitting a form, you agree to these Terms. If you do not agree, do not use our Services.

Our Services

AM Automations provides AI automation, voice AI receptionist, CRM setup, workflow automation, smart website, and lead conversion system services for local service businesses. Descriptions on our website are for general informational purposes only and do not constitute a binding offer. The specific scope of work, deliverables, timeline, pricing, and payment terms for any engagement are set out in a separate written proposal, service agreement, or statement of work executed by both parties.

Eligibility

You must be at least 18 years old and have the legal authority to enter into binding contracts on behalf of yourself or your business to use our Services. By using our Services, you represent that you meet these requirements.

Inquiries & Communications

When you submit a form or request a demo, you consent to be contacted as described in our Privacy Policy, including by phone, SMS, and email — and, where you have separately consented on our form, by automated, AI-assisted, or prerecorded voice technology. You may opt out of texts by replying STOP and of calls by requesting to be placed on our internal do-not-call list.

AI Systems Disclosure

AM Automations uses AI-powered systems, including AI voice agents, to handle calls and messages. Our AI agents will identify themselves as AI at the start of any interaction. AI systems assist with scheduling, intake, and follow-up communications and are not a substitute for human judgment on sensitive, legal, medical, financial, or emergency matters. We recommend human oversight for any consequential decisions.

Acceptable Use

You agree not to:

• Use our Services for any unlawful purpose or in violation of any law.
• Submit false, misleading, or fraudulent information.
• Attempt to reverse-engineer, scrape, or exploit our systems.
• Use our Services to transmit spam, unsolicited messages, or harmful content.
• Impersonate any person or entity.

Quotes, Payment & Deposits

• Quotes and estimates displayed on our website are for illustrative purposes and are subject to change based on scope, business type, and configuration requirements.
• Final pricing, payment schedules, and any applicable setup fees are confirmed in writing before work begins.
• Deposits or upfront payments may be required to begin work. Unless otherwise stated in your agreement, deposits are non-refundable once work has begun.
• Recurring subscription fees are billed in advance on the cycle stated in your agreement. Late payments may result in service suspension.

Cancellation & Refunds

Cancellation terms, notice periods, and refund eligibility (if any) are specified in your individual service agreement. In the absence of a written agreement, all fees paid are non-refundable. Cancellation of a subscription stops future billing but does not entitle you to a refund of fees already charged.

Intellectual Property

All content on our website — including text, graphics, logos, and code — is the property of AM Automations or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works without our prior written consent.

For client deliverables (automations, websites, CRM configurations), ownership and licensing terms are set out in your individual service agreement. Unless otherwise agreed, AM Automations retains ownership of proprietary frameworks, templates, and workflows used to build your system, and grants you a non-exclusive license to use the configured output.

No Guarantee of Results

We do not guarantee specific business outcomes, revenue figures, lead volumes, conversion rates, or return on investment. Results depend on many factors outside our control, including your offer, market conditions, traffic sources, sales process, and implementation quality. Any case studies, testimonials, or example results on our website represent individual outcomes and are not typical.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AM AUTOMATIONS, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL AM AUTOMATIONS’ TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO AM AUTOMATIONS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless AM Automations and its members, managers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) content or information you provide to us; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.

Dispute Resolution

Informal resolution: Before filing any formal claim, you agree to contact us at info@am-automations.com and give us 30 days to attempt to resolve the dispute informally.

Governing law: These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.

Venue: Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you irrevocably consent to the personal jurisdiction and venue of those courts.

Class action waiver: To the extent permitted by law, you waive any right to bring claims on a class or representative basis.

Modifications

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. For material changes, we will make reasonable efforts to notify you. Your continued use of our Services after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using our Services.
